Automated Generation of Timestamped Patent Abstracts at Scale to Outsmart Patent-Trolls

چکیده
The fundamental idea of patent systems is to protect inventors who have invested resources during the development of their invention. Patent trolls abuse these systems by filing obvious patents with significantly less cost and usually without the intention to produce or offer the invention. Instead, patent trolls sue other companies that allegedly violate their obvious patents. We propose a method that challenges patent trolls by generating large amounts of obvious patent abstracts automatically. In contrast to prior art, our approach generates abstracts for any patent category and achieves high diversity in content and structure of the resulting abstracts. Furthermore, we timestamp the generated abstracts using a decentralized timestamping service so that users can prove that a generated abstract existed at a certain point in time. In a survey, we found that the quality of the generated abstracts, using criteria defined by the European Patent Office, was 6% higher compared to prior art.

Patent Trolls on Markets for Technology – An Empirical Analysis of Trolls’ Patent Acquisitions
Patent trolls—firms that appropriate profits from innovation by enforcing patents against infringers—are peculiar players on markets for technologies. As buyers of patents, they are solely interested in the exclusion right, not in the underlying knowledge. Similarly, when they sell or license out patents, the transaction does not involve a technology transfer. In this paper, we empirically anal...
متن کاملWho's Afraid of the Patent Trolls? Assessing the Market Impact of Landmark Patent Troll Litigation Outcomes
Patent trolls have changed the innovation and patent policy landscape. This thesis is an empirical event study that focuses on two landmark cases of patent troll litigation, RIM v. NTP and eBay v. Mercexchange, to determine whether pro-troll litigation outcomes significantly impact the market values of the firms in the high-tech industries they target. I find that the Supreme Court ruling in eB...

Patent assertion entities, sometimes known as ‘patent trolls,’ do not manufacture goods themselves but profit from licensing agreements that they often enforce via the threat of litigation. This paper explores empirically how litigation by one such patent troll affected the sales of medical imaging technology. It finds evidence that relative to similar products, made by the same firm, but not c...

I introduce and analyze an equilibrium model of invention, patenting and infringement under monopolistic competition. Profitable use of inventions requires adaptation to complementary technologies. With patents, a thicket of conflicting rights emerges and costly infringements occur. This taxes invention and lowers welfare. When an inventor may be a “troll”—patent without inventing—the rate of i...
